Terms & Conditions

Clear Terms, Clear Expectations,

1.1 Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the Care Concierge website and online services. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website. These website Terms are separate from any client service agreement, employment or contractor agreement, payment authorization, or other agreement you may enter into with Care Concierge.

1.2 About Care Concierge

Care Concierge Inc. is a Georgia business developing and operating non-skilled private home care services within its authorized scope. Services may include companionship, sitter services, homemaking, housekeeping, and hands-on personal care such as assistance with bathing, dressing, toileting, grooming, eating, ambulation, and transfers, when included in an appropriate service agreement and service plan. Availability depends on licensing status, staffing, geography, client needs, safety, and other operational requirements.

1.3 No Emergency Services

Care Concierge is not an emergency medical service. Do not use the website, email, text messaging, or online forms for a medical emergency or other immediate threat to health or safety. Call 911 or seek appropriate emergency assistance.

1.4 No Medical Advice or Skilled Nursing Through the Website

Website content is provided for general informational purposes and does not constitute medical advice, diagnosis, treatment, nursing advice, legal advice, or a substitute for professional care. Care Concierge's current non-skilled service model does not represent that skilled nursing, therapy, hospice, medical treatment, or other separately licensed clinical services are available. Any required RN or qualified supervisory oversight of personal care should not be interpreted as the provision of skilled nursing services.

1.5 No Client Relationship From Website Use

Submitting an inquiry, requesting a consultation, communicating through the website, or receiving an automated response does not by itself create a client-provider relationship or obligate Care Concierge to accept a person for services. A service relationship begins only after Care Concierge completes its applicable intake and acceptance process and the required service agreement or other written documentation is executed.

1.6 Service Eligibility and Availability

Care Concierge may evaluate whether requested services fall within its licensed scope and whether it can safely and reasonably provide them. Care Concierge may decline or discontinue services as permitted by applicable law and the governing client agreement when needs exceed the agency's authorized scope, safe staffing cannot be arranged, required information is unavailable, the environment is unsafe, payment terms are not met, or other lawful grounds exist. Client rights under Georgia law and the applicable service agreement remain controlling.

1.7 Services at Homes and Other Locations

Services are primarily intended to be delivered where authorized private home care services may lawfully be provided. Care Concierge may also support an established client at a hospital, rehabilitation facility, assisted living setting, community location, or other non-home site when the requested non-skilled service is lawful, within Care Concierge's scope, consistent with the client's plan, and permitted by the host facility. Care Concierge does not operate a residential care facility or clinic through this website.

1.8 Website Inquiries and Accuracy of Information

You agree to provide information that is accurate to the best of your knowledge and to promptly communicate material changes that may affect a care request. Do not impersonate another person or submit information about another individual unless you are authorized to do so. Care Concierge may rely on information provided by a client, responsible party, or authorized representative when evaluating a request.

1.9 Pricing, Billing, Cancellations, and Payments

Website descriptions or estimates do not constitute a final quote unless expressly stated. Rates, minimum hours, deposits, cancellation charges, travel charges, payment schedules, and refund terms applicable to home care services will be stated in the client service agreement or other applicable written terms. If there is a conflict between these website Terms and an executed client service agreement concerning purchased services, the executed service agreement controls for that issue.

1.10 Electronic Signatures and Communications

Where Care Concierge offers electronic signatures, electronic records, or electronic delivery of documents, you agree that electronic signatures and records may be used to the extent permitted by law. You are responsible for providing accurate contact information and maintaining access to the email address or telephone number you designate. Certain notices may still be provided on paper or through another method when required or appropriate.

1.11 SMS and Email Terms

By providing contact information and requesting communication, you authorize Care Concierge to respond regarding your inquiry or service relationship through the channels you provide, subject to applicable law. Optional marketing consent will be obtained separately when required. Marketing consent is not a condition of purchasing services. Message frequency may vary; message and data rates may apply. Reply STOP to opt out of marketing texts and HELP for assistance where supported. Do not send urgent medical information by text.

1.12 Acceptable Website Use

You may use the website only for lawful purposes. You may not attempt to gain unauthorized access to systems or records; introduce malware; interfere with website operation; scrape or harvest information in violation of law; submit fraudulent, threatening, discriminatory, or unlawful content; misuse forms or communication tools; or use website content in a manner that infringes intellectual-property or privacy rights.

1.13 Intellectual Property

Unless otherwise stated, the website's original text, branding, graphics, logos, design elements, forms, and other content are owned by or licensed to Care Concierge and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal, non-commercial use. No ownership rights are transferred by your use of the website.

1.14 Third-Party Services and Links

The website may use or link to third-party tools for scheduling, forms, payments, communications, maps, social media, or other functions. Care Concierge does not control independent third-party websites and is not responsible for their separate content, availability, or practices. Use of a third-party service may also be governed by that provider's terms.

1.15 Disclaimer of Website Warranties

Care Concierge endeavors to keep website information accurate and available, but the website is provided on an "as available" basis. To the fullest extent permitted by law, Care Concierge does not warrant that the website will always be uninterrupted, error-free, secure, or free of harmful components, or that every description will remain current. Nothing in this section waives rights that cannot legally be waived.

1.16 Limitation Relating to Website Use

To the fullest extent permitted by applicable law, Care Concierge will not be liable for indirect, incidental, special, or consequential losses arising solely from use of or inability to use the public website. This limitation does not limit obligations or liability arising from actual home care services, professional duties, gross negligence, willful misconduct, statutory rights, or other liability that cannot lawfully be limited.

1.17 Indemnification for Misuse

To the extent permitted by law, you agree to be responsible for losses or claims caused by your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights. This provision does not shift to a client responsibility for Care Concierge's own negligence or legally non-waivable duties.

1.18 Governing Law

These website Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute concerning only the public website will be handled in a court of competent jurisdiction as permitted by applicable law. Nothing in these Terms limits a client's right to make a complaint to the Georgia Department of Community Health or another government authority.

1.19 Changes to Terms

Care Concierge may revise these Terms as its website, services, technology, or legal obligations change. Revised Terms will be posted with an updated effective date. Continued use of the website after publication of revised Terms constitutes acceptance to the extent permitted by law.
